Service Agreement & Terms of Service

This document governs our remote PC optimization and monitoring services (“the Service”) provided to you by you (“the Client”) and Patrick Edwards (“the Technician”).
By agreeing to the Service and authorizing remote access to your computer, you agree to be bound by the terms of this agreement.
1. Description of Services
The Technician provides remote computer support, including, but not limited to:
- PC Tune-Up Services: A one-time service to optimize PC performance by removing temporary files, disabling unnecessary startup programs, checking for malware, and updating key software.
- Peace of Mind Subscription: A recurring monthly service for proactive maintenance, security scans, and limited remote support, as outlined in the service plan.
2. Client Responsibilities & Data Backup
- CRITICAL: You are solely responsible for backing up all important personal and business data (documents, photos, financial records, etc.) before any remote session begins.
- The Technician is not responsible for any data loss, regardless of the cause.
- You must provide a stable internet connection and must not interrupt the remote session without consulting the Technician.
3. Payment and Fees
- One-time services must be paid in full before work begins.
- Subscription services are billed in advance on a monthly or annual basis and will auto-renew until canceled.
- All prices are listed on our website and are subject to change with 30 days’ notice for new subscribers.
4. Refund & Satisfaction Policy
- One-Time Tune-Up: Your satisfaction is our goal. If you are not satisfied with the results of the tune-up, please contact us within 48 hours. We will make every reasonable effort to resolve the issue to your satisfaction. If, after a good-faith attempt to resolve the problem, we are unable to provide a measurable improvement in performance, we will issue a full refund. This policy protects against fraud while ensuring you receive a valuable service.
- Subscriptions: You may cancel your subscription at any time. You will retain access until the end of your paid billing period. No refunds will be issued for the current or partial months of an active subscription.
5. Limitation of Liability & Waiver
- You Agree: The Technician’s service is limited to software configuration and optimization. The Technician is not responsible for:
- Data loss under any circumstance.
- Hardware failures, software incompatibilities, or issues arising from pre-existing conditions on your PC.
- Any consequential damages (e.g., loss of business, lost profits) resulting from the service.
- You authorize the Technician to make software changes to your system. While the Technician takes care by creating a system restore point, you agree to assume all risks associated with these changes. The Technician will not be held liable for any damages arising from the provision of the service.
6. Scope of Service & Confidentiality
- The Technician will only access areas of your computer necessary to perform the requested service.
- All client information and data observed during a session will be kept strictly confidential and will not be shared with any third party.
7. Termination
- The Technician reserves the right to refuse service or terminate a session if a client is abusive, engages in illegal activities, or requests a service that is outside the Technician’s scope of practice or violates these terms.
8. Governing Law
This agreement shall be governed by the laws of the State of Florida.
